CD Wow Update

If you remember before Christmas I posted this post about the craziness of CD-WOW being sued by the IRMA. If you can cast your mind back to the CD-WOW facts page on the IRMA website, it said many things that were clearly libelous. So it was with great delight that I read yesterday that CD-WOW are now counter sueing the IRMA

Let’s hope they win, and the IRMA are forced to drop their case, which would mean I could keep getting cheap CDs!

    Over here, the BPI are suing them too, and suing Amazon and Play.com while they’re at it. It’s going to the High Court in early February. Unfortunately, the only legal precendent here is the Tesco vs Levis case, where Tesco imported cheaper Levi jeans from Eastern Europe. The court ruled in favour of Levis when they argued that Tesco was somehow tarnishing their image by charging less.

    Of course, this wouldn’t be an issue if the record labels made their music more affordable…

    I agree their is a bit of a precedent in Britain but can you argue that Record Labels, have a designer image in the same way as Levis do?

    I can see how you could argue that designer jeans or what not need to preserve an image, but how can you argue that people won’t buy music because it’s not exclusive enough?

    That is good news. Personally I think they could have won in the BPI suit instead of backing down.
